Usul al-Fiqh

What this science is

حقيقة أصول الفقه

Usul al-fiqh is the method by which a qualified scholar takes a hukm from its dalil. The word usul means roots. The word fiqh means understanding of the rulings of the Shariah that concern action. Put together: the roots from which understanding grows.

Three neighbours sit next to it. Qawaid fiqhiyyah are maxims inside the furu — hardship brings ease, certainty is not lifted by doubt. Maqasid are the aims of the Law — religion, life, mind, lineage, property. Mustalah al-hadith is how a report is authenticated. Usul is none of those three, though it borrows from all of them. Usul asks: once the ayah is an ayah and the hadith is sahih, what does the wording do?

  1. الدليل

    Dalil

A proof that can carry a ruling — an ayah, a hadith, ijma, or a valid qiyas.

  2. الحكم

    Hukm

What the Law says about an act: required, recommended, allowed, disliked, or forbidden.

  3. المجتهد

    Mujtahid

The one who has the tools to extract. Not every reader. Not Nur.

  4. المقلد

    Muqallid

The one who follows a mujtahid because he has not yet got the tools.

If you cannot weigh a chain, you are not doing usul. You are reading. That is honourable. Do not skip the teacher.
